The AllergyAware.ca website (Website) provides access to educational Content, including Online Courses, and trusted, evidence-based information about potentially life-threatening allergies and anaphylaxis. The Website is maintained by Food Allergy Canada and Leap Learning Technologies Inc.

The Website aims to be a trusted voice for information on serious allergic reactions and anaphylaxis for educators/school personnel, childcare providers and the general public. It includes online courses that provide evidence-based instruction about anaphylaxis, with the ability to view course content and produce a Certificate of Completion after completing the required course content and achieving a passing score on the review quiz.

The Website does not require users to create an account or log in to access the Online Courses. Because there are no user accounts, course progress is not saved if you leave the course or close your browser. Users should plan to complete the course in a single session and download any Certificate of Completion immediately after it becomes available. ACCEPTANCE. This Terms of Use Agreement ("Agreement") is a legal agreement between you and Food Allergy Canada and Leap Learning Technologies Inc. ("Owners"), the owners and operators of the AllergyAware.ca Website (the "Website"). It states the terms and conditions under which you may access and use the Website. By accessing and using the Website, you are indicating your acceptance to be bound by and comply with the terms and conditions of this Agreement. If you do not accept these terms and conditions, you must not access or use the Website. The Owners may revise this Agreement at any time by updating this posting. Use of the Website after such changes are posted will signify your acceptance of the revised terms. You should visit this page periodically to review this Agreement.

USE OF WEBSITE. Information made available on the Website in any form is for information purposes only. It is not intended to provide professional medical, legal or medico-legal advice, nor is it intended to be a substitute thereof. ONLINE COURSES AND CERTIFICATES. The Website will offer online courses related to potentially life-threatening allergic reactions and anaphylaxis (an "Online Course"). The Owners reserve the right to cancel, interrupt or reschedule any Online Course or modify its content as well as any of the course content, review quiz, certificate requirements, or other evaluation of progress. Online Courses offered are subject to the Disclaimer of Warranties / Limitation of Liabilities section of this Terms of Use agreement.

For some courses, subject to your meeting certain requirements such as viewing required course content and achieving a passing score on a review quiz, you may be provided with a Certificate of Completion. This document is essentially just a statement acknowledging your completion of the requirements of the Online Course. You acknowledge that the Certificate of Completion, if provided to you, may not be affiliated with the Owners or any of their affiliate colleges or universities.

Because the Website does not require or provide user accounts, your course progress is not saved if you leave the course, close your browser, lose your internet connection, or otherwise interrupt your session. You are responsible for completing the Online Course in a single session and downloading or saving your Certificate of Completion immediately after it becomes available. The Owners are not responsible for lost, unavailable, or undownloaded Certificates of Completion after you leave the course or close your browser. Further, the Owners maintain the right to offer or not offer any such Certificates of Completion for a course. You acknowledge that the Certificate of Completion, and the "Owners" Online Courses, will not stand in the place of a course taken at an accredited institution, a training course provided by your employer or another training organization, and do not convey academic credit.

You acknowledge that the Owners will not be involved in any attempts to get the course recognized by any educational or accredited institution, unless explicitly stated otherwise by the Owners. The format of the Certificates of Completion will be determined at the discretion of the Owners, and may vary by course in terms of formatting, e.g., whether or not it reports your quiz score, completion date, or other course information, and in other ways.

You may not take any Online Course offered by the Owners or use any Certificate of Completion as part of any tuition-based or for-credit certification or program for any college, university, or other academic institution without the express written permission from the Owners. Such use of an Online Course or Certificate of Completion is a violation of these Terms of Use.

Completion of any of our Online Courses is strictly for educational/informational purposes and does not imply competency, proficiency, and/or experience. The Certificate of Completion is not a clinical certification nor a type of licensure.

LIMITED LICENCE. Subject to the terms and conditions of this Agreement, you are hereby granted a limited revocable non-exclusive licence to access, view and use the Website for your non-commercial use, and are granted the right to download, store and print single copies of items comprising the Content for your non-commercial use, provided that you maintain all copyright and other notices contained in such Content.

FEES AND PAYMENTS. Users from Canada and from low-and middle-income countries have a free, non-exclusive licence to use this Website. The Owners reserve the right to charge licensing, registration or user fees in the future for certain categories of users or types of use of this Website.

LIMITATION OF LIABILITY. Subject to applicable law, in no event shall the Owners and their partners, employees, consultants, agents or licensors be liable for damages of any kind including, without limitation, any direct, special, indirect, punitive, incidental or consequential damages including, without limitation, any loss or damages in the nature of or relating to lost business, lost savings, lost data, lost Certificates of Completion and/or lost profits arising from your use of, reliance upon, or inability to use the Website or the Content, regardless of the cause and whether arising in contract (including fundamental breach), tort (including negligence), or otherwise. The foregoing limitation shall apply even if the Owners knew of or ought to have known of the possibility of such damages.

DISCLAIMER OF WARRANTIES. The Website and the Content is provided "as is" and "as available", without warranty or condition of any kind, either express or implied. The Owners expressly disclaim all warranties and conditions, including any statutory or implied warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment or non-infringement in respect to the Website and the Content, to the fullest extent permissible under applicable law. While the Owners endeavour to provide Content that is correct, accurate and timely, no representations or warranties are made regarding the Website and/or the Content including, without limitation, the Owners provide no representation or warranty that (i) the Website or Content will be accurate, reliable, complete, current, timely or suitable for any particular purpose, (ii) that the operation of the Website will be uninterrupted or error-free, (iii) that defects or errors in the Website or the Content will be corrected, (iv) that the Website will be free from viruses, malware, worms or other harmful components, and (v) that communications to or from the Website will be secure and/or not intercepted. You acknowledge and agree that you are using the Website and the Content, if applicable, at your own risk and liability.

RELEASE AND INDEMNITY. You hereby agree to release the Owners and their partners, employees, consultants, agents and licensors from, and in no event shall any or all of the Owners and their partners, employees, consultants, agents or licensors be liable to you or any other person or entity, for any and all liabilities and damages (including any direct, indirect, special, exemplary or consequential damages, including lost profits) whatsoever arising from your use of the Website (including any breach by you thereof), the Content or otherwise relating to this Agreement and you agree that your sole remedy for any claim, loss, damage, costs or expenses is to cease using the Website. You will indemnify and hold harmless the Owners and its partners, employees, consultants, agents or licensors from and against any claims, losses, judgments, damages, costs and expenses (including without limitation, reasonable legal fees) incurred by any of them due to or resulting from your use of the Website, the Content or otherwise relating to this Agreement (including any breach by you thereof). You will also indemnify and hold harmless the Owners and their partners, employees, consultants, agents or licensors from and against any claims brought by third parties arising out of your use of the Website or its Content.

NO ACCOUNTS OR REGISTRATION. The Website does not require users to create an account, register, log in, or maintain a password in order to access the Online Courses. Because there are no user accounts, the Website does not save your course progress for later use. If you leave the course before completing it, you may need to begin again from the start.

If you are under 18 years of age, parent or guardian consent may be required to use the Website or complete an Online Course.

You may also have the option of signing up to receive email updates or periodic e-newsletters, where such options are available. By providing your email address for this purpose, you are giving the Owners your consent to receive such communications. You may unsubscribe from these communications in accordance with the instructions provided in the communication.

CERTIFICATE INFORMATION. After completing the required Online Course content and achieving a passing score on the review quiz, you will be asked to provide certain mandatory information in order to generate your Certificate of Completion. This information may include your full name, email address, organization, role, job title, and province.

Your full name and email address will be used as you enter it to display your name and email on the Certificate of Completion. Your organization and job title may also be displayed on the Certificate of Completion, depending on the certificate format. Your role and province are collected for reporting, evaluation, and aggregate metrics purposes and will not be displayed on the Certificate of Completion.

Your email address is collected so that the Website can send you an email containing a unique link to access your Certificate of Completion in the future. This feature is intended to help users retrieve their certificate if they do not download it immediately after completing the course. You are still responsible for downloading and saving your Certificate of Completion when it becomes available.

You agree that you any information you provide for certificate generation will be true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or if the Owners have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may refuse any and all current or future use of the Website or any portion thereof.

PRIVACY POLICY. Your use of the Website may enable you to access Content such as Online Courses. The Owners will not share personal information gathered on this Website with any other parties except as described in this Agreement, the Privacy Policy, or as otherwise permitted or required by law. It is the Owners' intention to protect against improper use of your personal information. Accordingly, the Owners have provided safeguards for the protection and storage of any personal information you provide.

Access to personal information is limited exclusively to those individuals who require it for purposes related to operating, maintaining, improving, or supporting the Website, Online Courses, Certificates of Completion, email communications, or related services. All personal information created, held or collected by the Owners is protected and used in compliance with the Freedom of Information and Protection of Privacy Act (Ontario) and will be disclosed only in accordance with this Act.

In order to provide users with a Certificate of Completion for Online Courses, certain information may be processed during your active course session, such as your progress through required course content, your responses to review quiz questions, and whether you achieved a passing score. After you complete the required course content and achieve a passing score on the review quiz, you will be asked to provide certain mandatory information to generate your Certificate of Completion, including your full name, email address, organization, role, job title, and province.

Your full name will be used to display your name on the Certificate of Completion. Your organization and job title may also be displayed on the Certificate of Completion, depending on the certificate format. Your role and province are collected for reporting, evaluation, and aggregate metrics purposes and will not be displayed on the Certificate of Completion. Your email address is collected so that the Website can send you an email containing a unique link to access your Certificate of Completion in the future.

Although the Website does not use user accounts or passwords, limited certificate-related information. may be stored to allow you to access your Certificate of Completion using the unique link sent to the email address you provide. Course progress before completion is not saved in a way that allows you to leave the course and resume later.

We may use, maintain, and store limited information to provide certain services to you, operate and improve the Website, generate Certificates of Completion during an active session, respond to technical support requests, or meet legal, administrative, security, or operational requirements.

Information gathered during activities on the Website may be aggregated with that of other users so that we can make decisions about how to improve the Website. The information collected will not be linked to specific individuals, but will be accessed in aggregate form. Statistical information may also be used for research purposes, e.g., to validate the effectiveness of a learning program or e-learning courses, but in all such circumstances will remain anonymous or de-identified. Aside from the foregoing uses, the information you provide and any other information, will be protected and used in compliance with Ontario's Freedom of Information and Protection of Privacy Act (RSO 1990) and will be disclosed only in accordance with this Act. In addition to voluntary information provided and limited information processed during use of the Online Courses, the Website may use web analytics tools that report on how visitors interact with the Website, to collect non-personal information and data. These tools collect information anonymously and report Website trends without identifying individual visitors. "Cookies" are small text files that identify an individual computer's browser entering a website. REPORTING DATA TO ORGANIZATIONS. Because the Website does not require user accounts or logins, the Owners do not provide routine individual reporting of course progress, completion status, quiz performance, or Certificates of Completion to employers, school boards, camps, daycares, or other organizations, unless a specific reporting arrangement has been established with that organization.

If you are required to provide proof of completion to an organization, you are responsible for downloading, saving, and submitting your Certificate of Completion to that organization after completing the Online Course and achieving a passing score on the review quiz.

The Owners may use aggregate or de-identified information, such as organization, role, job title, province, course completion counts, or other summary metrics, for reporting, evaluation, quality improvement, and planning purposes. Such reporting will not identify individual users unless the user has provided consent or disclosure is otherwise permitted or required by law.

PASSWORDS. The Website does not require users to create or maintain passwords or user IDs to access the Online Courses. You are responsible for accessing the Website using a secure device, browser, and internet connection. If, in the future, any password-protected features are added to the Website, any passwords and user IDs used for this Website will be for individual use only. You will be responsible for the security of your password and user ID, and you will be responsible for all activities that occur under your user name and password.

EXTERNAL SERVICE PROVIDERS. To effectively operate its websites, the Owners occasionally use external service providers which may be located within Canada or outside Canada, and may be outside your jurisdiction of residence. Such service providers are bound by contract with the Owners to treat any personal information they may receive in a manner that is consistent with the provisions of applicable privacy laws. The Owners cannot guarantee the security of any communication to or from the Website. The Owners do not assume any responsibility or risk for your use of the Internet. Although the Website does not require user accounts, passwords, or logins for access to the Online Courses, any personal information provided through the Website may still be subject to security risks associated with internet use. Should there be a security or data breach involving personal information, affected users will be notified where required by applicable law and where sufficient contact information is available.

GOVERNING LAW AND JURISDICTION. The Website is operated by the Owners within the Province of Ontario, Canada. By accessing or using the Website, you agree that all matters relating to your access to, or use of, the Website and its Content shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree and hereby submit to the non-exclusive jurisdiction of the courts of the Province of Ontario with respect to all matters relating to your access to and use of the Website. In the event of a dispute, all efforts will be made to agree to an alternative dispute resolution in place of litigation.

TERMINATION. The Owners may, in their sole discretion, cancel or terminate your right to use the Website, or any part of the Website, at any time without notice. In the event of termination, you are no longer authorized to access the Website or the part of the Website affected by such cancellation or termination. The restrictions imposed on you with respect to both Content and the Website set out in this Agreement shall survive. The Owners shall not be liable to any party for such termination.

ENTIRE AGREEMENT. Except for any agreement in respect of Content, this is the entire agreement between you and the Owners relating to your access and use of the Website and the Content herein.

GENERAL. If any term or provision of this Agreement is held by a court of competent jurisdiction to be invalid, it shall be severed and the remaining provisions shall remain in full force and effect without being invalidated in any way. You may not assign, convey, subcontract or delegate your rights, duties or obligations hereunder. The Owners will not be considered to have waived any of their rights or remedies described in this Agreement unless the waiver is in writing and signed by the Owners. No delay or omission by the Owners in exercising their rights or remedies will impair the Owners' rights or be construed as a waiver. Any single or partial exercise of a right or remedy will not preclude further exercise of any other right or remedy. The Owners' failure to enforce the strict performance of any provision of this Agreement will not constitute a waiver of the Owners' right to subsequently enforce such provision or any other provisions of this Agreement. The headings used in this Agreement are included for convenience only and have no legal or contractual effect.
